The terms and conditions set out below are applied to all bookings made through the website museumhotel.com.my. Museum Hotel Sdn Bhd is a company registered in Malaysia whose registered office is at No.76 Jalan A.S.Mansoor (Off from Transfer Road), 10050 Penang. Through this document, Museum Hotel Sdn Bhd may be referred to “we”, “our” and “us”.

Please read this document carefully before accessing or using the website. By accessing or using the website, you agree to be bound by the terms and conditions set forth below. If you do not agree to each and all of these terms and conditions please do not use the website.

 

PRICING

 

All prices shown online are per room per night (unless otherwise stated).

Prices are subject to change without notice. However, your price is guaranteed once you receive a booking confirmation. Room prices do not include any incidental charges, which you may incur during your stay. Such charges will be payable by you on your departure and, in the event that you fail to pay any such incidental charges, it is a condition of your contract with us that you irrevocably authorize us to debit your credit or debit card (see 'Deposits and Pre-payments' below) for the amount of any shortfall.

 

AVAILABILITY

 

Availability of rooms at the rates shown online may be limited and/or restricted to certain periods.

 

GUESTS WITH IMPAIRED MOBILITY

 

The hotel endeavours to offer the same high quality facilities to our less able bodied guests. Where possible, special facilities include wheelchair adapted bathrooms, ramps and lifts in public areas. We will do our best to accommodate your wishes.

 

CAR PARKING

 

We do offer free parking for all our hotel customers, subject to availability.

 

SMOKING

 

Please note that all the rooms and public areas are fully non-smoking.

 

ARRIVAL AND DEPARTURE

 

Hotel rooms are available from 2pm on the day of arrival. Rooms must be vacated by 12 noon on the day of departure, unless otherwise sanctioned at the discretion of the hotel manager.

 

DEPOSITS AND PRE-PAYMENTS

 

The pre-payment of the room will requested 7 days prior arrival unless otherwise at the discretion of the hotel manager.
A deposit will be requested if the room is paid by cash.

 see “BALANCE OF MONIES OUTSTANDING” below). However, you will be asked to guarantee your booking with a valid credit or debit card. Payment upon approval from guest before the cancellation period or in the event of cancellation other than in accordance with our cancellation policy. See “CANCELLATIONS AND AMENDMENTS” below for details on cancellations.

 

BALANCE OF MONIES OUTSTANDING

 

Upon your arrival, you will be asked to produce a valid debit or credit card for the hotel to take authorisation. If you are settling your account in cash, you will be asked for a deposit. We accept Master Card, Visa Card, Union Pay, Edebit Card.

 

CANCELLATIONS AND AMENDMENTS

 

All cancellations or amendments must be made in accordance with our policy:

• Any cancellation received within 7 days prior to arrival date will incur the full period charge.
Failure to arrive will be treated as No-Show, any adjustments (shorter stay) received within 7 days prior arrival, no refund will be given.

• Any cancellations or adjustments of reservation must be made via museumhotel.com.my using the reservation number provided at the time of booking or in writing through email or by calling the hotel direct, and acknowledged by the hotel in return.

Whilst every effort is made to fulfil any particular requests which you may have in relation to your stay with us, we cannot guarantee that we will be able to meet any particular requests which you may make and our failure in this regard will not constitute a breach of contract.

For the avoidance of doubt, we shall have no further liability to you for any changes to or the cancellation of any online booking.

 

COMPLAINTS OR COMMENTS

 

We take our guest satisfaction very seriously. Any complaint or comment regarding your stay at our hotel should be made in the first instance to the hotel's duty manager at the time of your stay so that we can attempt to resolve it immediately.

We are committed to provide you with courteous and efficient service, whilst managing any challenges that you may experience. However, any treat of abuse or violence in any form whatsoever or any unacceptable behavior towards our staff or other guests will not be tolerated. We reserve the right to refuse a booking and apply any provisions of our cancellation policy to protect our staff and guests

 

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of this Web Site, you warrant to us that you will not use this Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

 

GENERAL INFORMATION

 

Although every effort has been made to ensure the accuracy of the information contained online, we cannot accept responsibility for any errors or omissions, and reserve the right to vary, amend, supplement or cancel any of the information or offers featured online at any time.

Subject to the paragraph immediately below, we shall not be liable to you for any loss or damage in circumstances where:

• There is no breach of a legal duty owed to you by us or by our employees or agents;

• Such loss or damage is not a reasonably foreseeable result of any such breach;

• Any increase in loss or damage resulting from breach by you of any term of our contract;

• Any loss is in excess of three times the fee payable in respect of your stay.

Nothing in these terms and conditions excludes or limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation.

We will, where information is required, explicitly ask proof of identity or any contact information. Generally this information is requested when making reservations, or when requesting a specific service. (“Personal Information”).

Any claim relating to this Terms and Conditions shall be governed by Malaysia laws, exclusive of the choice of law rules thereof. This Terms and Conditions constitute the entire agreement of the parties with respect to the subject matter hereof and supersedes all prior oral and written agreements. No failure or delay on the part of Museum Hotel in exercising any right or remedy hereunder or enforcing the Terms and Conditions will operate as a waiver thereof. If any part or provision of this Terms and Conditions is found to be invalid, unenforceable or void, then the remaining portion shall remain in full force and effect. Headings are for convenience only and not for use in interpretation of this Terms and Conditions.

 

CHANGE TO THIS TERMS AND CONDITIONS

We may at any time in its sole discretion reserve the right to change, modify, add, or remove portions of these terms at any time without notice and, unless otherwise indicated, such changes will become effective immediately; therefore, please check Terms and Conditions periodically for changes.
